RE: REQUEST OF JUDGE CLARENCE J. VILLANUEVA, RTC, BRANCH 7, BAGUIO CITY, TO COMPEL THE ATTENDANCE OF NATIONAL BILIBID PRISONER MULLER BALDINO y DICLAS IN HIS COURT

Sirs/Mesdames:

Quoted hereunder, for your information, is a resolution of this Court dated APRIL 5 2005.

The Court Resolved, upon the recommendation of the Office of the Court Administrator, to AMEND the resolution of 21 September 2004 to read as follows:

A.M. No. 99-5-160-RTC.- Re:  Request of Judge Clarence J. Villanueva, RTC, Branch 7, Baguio City, to Compel the Attendance of National Bilibid Prisoner Muller Baldino y Diclas in His Court.-  It appearing that the prosecution witnesses could not appear at the RTC, Branch 276, Muntinlupa City, due to their financial incapacity, the Court Resolved, upon the recommendation of the Office of the Court Administrator, to

(a)          GRANT therequest of Judge Norma C. Perello, RTC, Branch 276, Muntinlupa City, that the records of the following criminal cases against accused Muller D. Baldino be returned to their respective courts of origin for the taking of the testimonies of the witnesses for the prosecution, to wit:

(i)    Criminal Case No. 6498-CR-124

To RTC, Branch 63, La Trinidad, Benguet;

(ii)   Criminal Cases Nos. 99-592 to 593 to RTC, Branch 6, Baguio City; and

(iii)   Criminal Case No. 99-853 (15811-R) to RTC, Branch 7, Baguio City;

(b)          DIRECT the Branch Clerk of Court of RTC, Branch 276, Muntinlupa City, to forward the complete records of the above-mentioned crimnal cases to their respective courts of origin, within thirty (30) days from notice hereof; and

(c)          DIRECT Judge Benigno M. Galacgac, Judge Ruben C. Ayson and Judge Clarence J. Villanueva, Presiding Judges of RTC, Branch 63, La Trinidad, Benguet; RTC, Branch 6, Baguio City, and RTC, Branch 7, Baguio City respectively, to TRANSMIT the subject criminal cases back to RTC, Branch 276, Muntinlupa City, after the prosecutors have rested their cases, for the taking of the evidence of the accused in the New Bilibid Prisons at Muntinlupa City.” (78)
