RE: RESOLUTION PROVIDING FOR THE STAFFING PATTERN OF THE OFFICE OF THE COURT ADMINISTRATOR

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 22, 2005.

The Court Resolved to

(a) NOTE the Memorandum dated 1 February 2005 of Court Administrator Presbitero J. Velasco, Jr., submitting for the consideration of the Court the proposed Revised Organizational Chart of the Office of the Court Administrator, as well as the Duties and Functions of its officials (Court Administrator, Deputy Court Administrators and Assistant Court Administrator), filed in compliance with the resolution of 14 December 2004;

(b) APPROVE the aforesaid proposed Revised Organizational Chart of the Office of the Court Administrator as well as the Duties and Functions of its officials (Court Administrator, Deputy Court Administrators and Assistant Court Administrator), to take effect on 1 March 2005, to wit:

Court Administrator exercises supervision over the DCAs and ACAs who provide him with support functions to assist him in his performance of his functions as Court Administrator. The positions of the DCAs were created under P.D. No. 828 to assist the Court Administrator in his supervision over the lower courts. Pursuant to the law creating the OCA, the Supreme Court, by resolution, created the positions of the ACAs for the latter to likewise assist the Court Administrator and provide him with technical assistance.
The Court Administrator exercises direct supervision and control over the four (4) OCA offices.

The broken lines from the Court Administrator to the ACAs show the functions that he delegated to them (which functions are contained in the box specifying the delegated duties). The broken lines from the DCAs to the four (4) offices show the duties delegated by him to the DCAs over the four offices (which functions are likewise contained in the box below their offices).

B. Definition of the Role of the Court Administrator (CA), Deputy Court Administrators (DCAs) and Assistant Court Administrators (ACAs):

1.  Court Administrator

1.1.                         Assists the Supreme Court in the exercise of its administrative supervision functions vis-a-vis the lower courts;

1.2.                         Exercises overall authority and direct control and supervision over the Court Management Office  (CMO), Legal Office (LEGO), Financial Management Office (FMO) and Office of Administrative Services (OAS-OCA);

1.3.                         Establishes the policies and standards for the internal operations of the OCA and lower courts to ensure that they are managed effectively, efficiently and economically;

1.4.                         Recommends to the Supreme Court policies, rules and regulations for the management and operations of the lower courts;

1.4             Directs the implementation by the OCA and lower courts of Supreme Court policies, rules and regulations;

1.5.                         Reviews and acts on the reports and recommendations of the DCAs, ACAs and the four (4) OCA Offices;

1.6.                         Assists the Supreme Court exercise administrative disciplinary authority over judges, lower court personnel and OCA officials and employees in accordance with existing laws as well as Supreme Court and civil service policies, rules and regulations;

1.7.                         Delegates authority to any of the DCAs or ACAs, including processing and evaluation of administrative grievances and complaints against judges and lower court personnel stationed in particular administrative regions;

1.8.                         Performs such other functions as may be delegated or assigned by the Supreme Court; and

1.9.                         Exercises such other functions provided under Presidential Decree No. 828, as amended by P.O. No. 842.

2.      Deputy Court Administrators

2.1.                 Assist the Court Administrator formulate and implement policies and standards for the internal operations of the four (4) OCA Offices and lower courts in the regions assigned to them;

2.2.                  Assist the Court Administrator act on administrative disciplinary matters concerning judges and lower court employees stationed in the regions assigned to them;

2.3.                 Exercise direct control and supervision over the judicial supervisors assigned to them, including the conduct of their judicial audit; and

2.4.                 Perform such other functions as may be delegated or assigned by the Court Administrator or the Supreme Court.

3.      Assistant Court Administrators

3.1.                 Assist the Court Administrator formulate and implement policies and standards for the internal operations of the four (4) OCA Offices and the lower courts;

3.2.                 Assist the Court Administrator oversee the operational activities of the Court Management Office  (CMO), Legal Office (LEGO), Financial Management Office (FMO) and Office of Administrative Services (OAS-OCA);

3.3.                 Assist the Court Administrator act on administrative disciplinary matters concerning judges and lower court employees in specified stations;

3.4.                 Assist the Court Administrator in all liaison and coordination activities with the Executive and Legislative Departments; and

3.5.                 Perform such other functions as may be delegated or assigned by the Court Administrator or the Supreme Court.
