REQUEST FOR THE RELEASE OF SALARIES OF (1) ATTY. BEVERLY SABIO-BEJA, ASSISTANT CLERK OF COURT, COURT OF APPEALS-MINDANAO STATION, CAGAYAN DE ORO CITY; AND (2) ATTY. MAY FAITH L. TRUMATA, DIVISION CLERK OF COURT, 20TH DIVISION, COURT OF APPEALS, CEBU CITY STATION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated MAR 1 2005.
Acting on the separate letters of Atty. Beverly Sabio-Baja, Assistant Clerk of Court, Court of Appeals-Mindanao Station and Atty. May Faith Trumata, Division Clerk of Court, 20th Division, Court of Appeals, Cebu City, requesting for the release of their respective clearances from that Office pending the outcome of the financial audit on their respective Books of Account while being the former Clerks of Court of the Regional Trial Court, Cagayan de Oro City and Pagadian City, respectively, the Court Resolved, upon the recommendation of the Office of the Court Administrator to
(a) ALLOW the issuance of a provisional SC Clearance to Atty. Beverly Sabio-Beja, Assistant Clerk of Court, Court of Appeals-Mindanao Station, Cagayan de Oro City and Atty. May Faith L. Trumata, Division Clerk of Court, 20th Division, Court of Appeals, Cebu City Station subject to the following conditions:
(i) Execution of an Affidavit of Undertaking stating, among others, that Attys. Beja and Trumata are willing to pay or restitute any shortage that may be found or discovered after the financial audit;
(ii) Letter authorizing the Court of Appeals to withhold their respective bonus and other benefits (e.g. RATYA, etc.) pending the outcome of the financial audit; and
(iii) Letter authorizing the Court of Appeals to withhold their salaries, bonus and benefits to answer for any shortage that may be found during the financial audit;
(b) AUTHORIZE the Office of the Court Administrator to enter into a Memorandum of Agreement with the Court of Appeals so that in case a court personnel, who is an accountable officer, had transferred to the Court of Appeals without prior notice to the Court while his/her books of account are still the subject of a financial audit, the Court of Appeals will coordinate with the Court for the appropriate implementation of the above-mentioned undertaking and authorization and the execution of whatever sanction the Court imposes upon the erring court personnel; and
(c) ALLOW the issuance of a provisional SC clearance to similarly situated court personnel who transferred to the Court of Appeals, subject to the same conditions set forth above.” Morales, J., on leave.
