RE: REQUEST FOR REFUND OF P10,000.00 CASH BOND ALREADY DEPOSITED WITH THE JUDICIARY DEVELOPMENT FUND
Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of this Court dated MARCH 29 2005.
The Court Resolved, upon the recommendation of the Office of the Chief Attorney, to
(a) APPROVE the request of bondsman Jessie F. Sabado for the refund of the amount of P10,000.00 filed as cash bond in Criminal Cases Nos. 14838-48, entitled People v. Sabado, on the ground of the acquittal of the accused;
(b) REQUIRE Mr. Sabado to present and surrender to the Fiscal Management and Budget Office the following documents: (i) the original receipt showing payment of the cash bond and (ii) a certified true copy of the decision dismissing the aforesaid criminal cases;
(c) DIRECT the Fiscal Management and Budget Office to coordinate with the Clerk of Court of the RTC of Cavite in the refund of the subject amount;
(d) ADMONISH the Presiding Judge of the Municipal Trial Court of Imus, Cavite, to observe pertinent rules and guidelines relative to fiduciary funds and to take cognizance thereof in the performance of his adjudication function; and
(e) REQUIRE the Office of the Court Administrator to draft, within thirty (30) days from notice hereof, the necessary guidelines on the procedure for the deposit of confiscated bonds with the Judiciary Development Fund account.” (adv146)
