RE: UNDATED LETTER WITH NEWS CLIPPINGS OF MR. ROMY SANTOS REQUESTING ASSISTANCE TO STAY THE REPORTED PROVISIONAL DISMISSAL BY DAVAO CITY JUDGES OF ARCHIVED CRIMINAL CASES FOR NON-ARREST OF THE ACCUSED

Sirs/Mesdames:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 15 2005.

The Court Resolved to NOTE the

(a)     Letter with news clippings of Mr. Romy R. Santos requesting assistance to stay the reported dismissal by Davao City judges of inactive criminal cases in compliance with the Court Circular relative thereto;

(b)     Memorandum of Deputy Court Administrator Christopher O. Lock submitting his reply to the 1^st Indorsement of 21 February 2005 on the reported provisional dismissal of archived cases in Davao City allegedly in compliance with the verbal directive of Hon. Presbitero J. Velasco, Jr., Court Administrator, relative to Section 8, Rule 117, Revised Rules on Criminal Procedure, and recommending that the Orders provisionally dismissing the 122 archived cases issued by Judge Renato A. Fuentes be ordered recalled; and

(c)     Memorandum dated 4 March 2005 of the Court Administrator Presbitero J. Velasco, Jr., submitting his explanation and clarification, re:  Memorandum of DCA Christopher O. Lock on the orders of Judge Renato Fuentes provisionally dismissing criminal cases subject of the letter of Mr. Romy Santos.”  (76)
