RE: HABITUAL TARDINESS of ROSE MARIE B. PE, STATISTICIAN II, RTC OCC, CEBU CITY
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 19 2005.
For consideration is respondent's Motion for Reconsideration dated 8 November 2004 of the Resolution dated 6 October 2004 finding her guilty of habitual tardiness and ordering her suspension for twenty (20) days, with stern warning that a repetition of the same or similar offense will be dealt with more severely. Respondent prays that the Resolution be set aside and stricken off from her 201 file or at least lowered to reprimand in consonance with the rulings of the Court against other employees of the court similarly situated.
To support her contention, respondent cites Administrative Matter No. P-04-1856 (Office of the Administrator vs. Ms. Josefina A. Mayol, Social Welfare Officer II, Regional Trial Court-OCC, Cebu City) decided on 26 July 2004. In the said case, respondent Mayol was found tardy for almost the same number of times as herein respondent and was meted the penalty of reprimand. Taking a good and hard second look of the present case and particularly considering that the frequent unauthorized tardiness complained against may be appreciated as the first offense only, the Court finds the motion for reconsideration well taken.
WHEREFORE, respondent's motion for reconsideration dated 8 November 2004 is GRANTED. Respondent is hereby REPRIMANDED, with a warning that a repetition of the same or similar offense will warrant the imposition of a more severe penalty.
