REQUEST OF THE CITY GOVERNMENT OF PASIG TO DEMOLISH THE PASIG HALL OF JUSTICE
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 1 2005.
The Court Resolved, upon the recommendation of the committee on Halls of Justice, with recommending approval of Clerk of Court Luzviminda D. Puno and Associate Justice Angelina Sandoval-Gutierrez, Chairman, same Committee, to
(a) NOTE and ACCEPT the draft Deed of Donation and Right of Usufruct from the City of Pasig, to wit:
DEED OF DONATION
KNOW ALL MEN BY THESE PRESENTS
The CITY GOVERNMENT OF PASIG, a public corporation, duly organized and created under Philippine laws, with office postal address at Pasig City Hall, Caruncho Avenue, Pasig city, represented in this act by City Mayor, HON VICENTE P. EUSEBIO, hereinafter referred to as the “CITY”.

THE SUPREME COURT OF THE PHILIPPINES, with office postal address at Padre Faura street, Manila, represented in this act by JUSTICE PRESBITERIO VELASCO, Jr., Court Administrator, hereinafter referred to as the “COURT”
WITNESSETH THAT:
WHEREAS, the CITY has just recently completed the construction of the Pasig City Hall of Justice building to accommodate the sixteen branches of the Regional Trial Court, National Capital Region, and other units of the justice system in Pasig which are still holding sessions and offices at the Rizal Provincial Capitol Compound.
WHEREAS, the construction were undertaken by the CITY as an expression of goodwill to the courts and a measure of the CITY’s contribution to the efficient administration of justice, ultimately redounding to the benefit of the City and its constituents.
WHEREAS, the old Hall of Justice has been demolished to give way to the development of the New Hall of Justice.
WHEREAS, it is necessary that the COURT shall have full control and dominion of the Hall of Justice by its consolidation of its possession and occupancy of the building as well as the land which it shall enjoy in usufruct for a period of fifty (50) years;
NOW, THEREFORE, for and in consideration of the foregoing premises, the CITY GOVERNMENT OF PASIG, by these presents, does hereby transfer and convey, by way of DONATION, unto the SUPREME COURT OF THE PHILIPPINES, that portion of the new Hall of Justice building constructed through the auspices and use of funds and resources of the CITY, for which was duly appropriated and expended in the total amount of Sixty-Five Million, Seventy-Three Thousand Three Hundred Eighty Nine Pesos and 61/100 (P65,073,389.61) while the lot herein described below shall be enjoyed in usufruct for a period of fifty (50) years from date hereof subject to renewal upon mutual agreement of both parties:
“A parcel of land 2,14__ square meters in size, approximately 51.4 West; Northwest from the corner of Market Avenue, and Caruncho Avenue, bounded on the North by Caruncho Avenue; on the East by Pasig City Health Center; on the south by National Office and on the West by existing road Right of Way.
The COURT hereby accepts this donation under the precise terms and conditions set out in this instrument, and hereby agrees that the building subject of this donation and the lot in usufruct shall be used as Hall of Justice, otherwise, ownership of the building shall automatically revert to the CITY;
IN WITNESS WHEREOF, authorized representative of the parties have hereunto affixed their signatures in the City of Pasig, Metro Manila, Philppines, this ______ day of ______________ 2005.
