Gentlemen:
Quoted hereunder, for your information, is a
resolution of this Court dated JUL 2 2002.
A.M. No. 00-8-05-SC (Re: Problem
of Delays in Cases Before the Sandiganbayan.)
(a) Before acting on the Motion
for Extension with Request for Modification dated 30 May 2002 of Presiding
Justice Francis E. Garchitorena, praying that his relief from his judicial and
administrative functions be abbreviated; that he be relieved of preparing the
decisions in the undistributed cases mentioned in the resolution of 28 November
2001 or he be given more time to comply with the above resolution; and/or that
the load of cases to be decided by him be reduced, the Court Resolved to
require justice Garchitorena to SUBMIT within
fifteen (15) days a complete list of Cases submitted for decision that are
still pending with him, including those that were “unassigned, “unaccounted for
or unreported, as well as of cases already decided or resolved by him, with
copies of such decisions or resolutions attached thereto.
(b) Before acting on the Motion
for Extension of Time filed by Justice Catalino R. Castañeda, Jr. on May 23,
2002, alleging that he had been operated on for replacement of aortic valve in
1998 which is being monitored regularly by his doctor until now and that “Aside
from the ailments, he has been suffering from diabetes mellitus; and his blood
pressure rises daily, especially in the afternoon”, the Court hereby RESOLVES to require Justice Castañeda,
Jr. to SUBMIT, within fifteen (15)
days from receipt of copy of herein Resolution:
(1) a medical certificate attaching to his
present medical condition and the extent of his capability to perform his
duties as Associate Justice of Sandiganbayan without endangering his life; and
(2) a complete updated list of cases
submitted for decision which have been assigned to him indicating therein the
dates when said cases were submitted for decision and the dates when said cases
were assigned to him.
(c) Before acting on the undated
letter of Justice Anacleto D. Badoy, Jr. filed on February 14, 2002 requesting that the three-month
period to decide the cases adverted to in the Resolution of the Court promulgated
on January 29, 2002 “be counted from the day he can overcome his severe back
pains and report back to work”; and on the Motion for Extension of Time filed
on May 28, 2002, alleging that his Cardiologist, Dr. Norbert Lingling Uy “had
advised him not to push himself too hard yet for fear of another relapse” and
praying that be “be granted an extension ending October 15, 2002 within which
to decide/resolve the cases and incidents assigned to him”, the Court RESOLVES to require Justice Badoy, Jr.
to SUBMIT, within fifteen (15) days
from receipt of copy of herein Resolution:
(1) a
medical certificate attaching to his present medical condition and the extent
of his capability to perform his duties as Associate Justice of Sandiganbayan
without endangering his life; and,
(2) a
complete updated list of cases submitted for decision which have been assigned
to him indicating therein the dates said cases were submitted for decisions and
the dates when said cases were assigned to him.
