Gentlemen:
Quoted hereunder, for your information, is a
resolution of this Court dated JAN 22 2002.
G.R. No. 148270 (Roger P. Galang
vs. Commission on Elections and Leonardo B. Roman.)
In his Manifestation of Desistance dated 9 January 2002 and filed on 11
January 2002, petitioner alleges as follows:
1. Petitioner makes it of record that he
is no longer interested in pursuing the prosecution of the instant action.
2. For the record, petitioner likewise
makes it known that he never knew of the implications of the initiation and
prosecution of the instant action which had its beginning in a proceeding
before the Office of the Provincial Election Supervisor of the Commission on
Elections docketed as SPA No. (PES) CO1-001 (PES, Balanga City, Bataan), and
entitled “IN RE PETITION TO DISQUALIFY LEONARDO B. ROMAN AS CANDIDATE FOR THE
ELECTIVE OFFICE OF GOVERNOR OF THE PROVINCE OF BATAAN. ROGER P.GALANG,
Petitioner-Intervenor, versus LEONARDO B. RAMAN, Respondent.”
3. Petitioner manifests that the only
reason for being [sic] of the above-quoted proceeding is the urgings, although
misleading at that, of Rep. Enrique “TET” Garcia of the Second District of the
Province of Bataan that it is to the best interest of the constituents of …
Bataan that the said proceeding be pursued of its logical and final conclusion.
4. Thus, the continued pendency of the
instant action is merely in consequence of a misunderstanding, if not
misappreciation, of petitioner of the significance thereof.
5. Petitioner therefore would like to
desist from further prosecuting the instant action now or thereafter and for
purposes thereof, states that he is mindful of the import and ramifications of
such a desistance as well as of his rights and obligations under the
Constitution and the laws.
6. The indulgence of the High Court is
most respectfully sought.
After due
deliberation, the Court hereby considers the Manifestation of Desistance to be,
in effect, a motion to withdraw or dismiss the petition, and Resolves to GRANT the Desistance and declare the
petition DISMISSED.
This case is now declared CLOSED and TERMINATED.
