[G.R. No. 130345.
August 5, 2002]
ATTY. TACUB vs. TAN
Gentlemen:
Quoted hereunder, for your
information, is a resolution of this Court dated AUG 5 2002.
G.R. No.130345
(Atty. Pacifico B. Tacub vs. Wenceslao Vinzons Tan.)
For the Court’s consideration is the letter, dated 18 March 2002, of Wenceslao Vinzons Tan appealing, among other things, for an early resolution of his petition in G.R. No. 130345. (His request for early resolution in CA G.R. CV No. 53221 has meanwhile been referred to the Court of Appeals.)
The
antecedent facts of the case (G.R. No. 130345):
On 16 July
1997, the Integrated Bar of the Philippines, in its Resolution No. XII-97-139
in CDB Case No. 214, entitled “Wenceslao Vinzons Tan vs. Atty. Pacifico B.
Tacub,” resolved to DISMISS the charge for conflict of interest against
respondent for lack of merit, and with respect to the second charge of foisting
falsehood and disrespect to the commission Atty. Tacub was CENSURED with
warning that a repetition will merit a more severe penalty.
On 12
September 1997, a petition was filed by respondent Atty. Pacifico Tacub,
docketed G.R. No. 130345, which Atty. Tacub assailed the resolution of the IBP
Board of Governors. The Court, in its resolution of 08 October 1997, treated
the petition as a motion for reconsideration in administrative case CBD 214
and referred the same to the IBP. The IBP, in its Resolution No. XIII-99-87,
dated 22 April 1999, resolved to deny respondent’s petition for review for lack
of merit. The Court, in its resolution of 06 July 1999, NOTED the Notice of
Resolution of the IBP.
Acting now
on the petition (heretofore so treated as a motion for reconsideration in
Administrative Case No. 214), the Court hereby RESOLVED to deny the same for
lack of merit and to consider the case closed and terminated.
Very truly yours,
VIRGINIA ANCHETA-SORIANO
Clerk of Court
