Quoted hereunder, for your information, is a resolution of this Court dated FEB 3, 1999.

G.R. No. 136375 (Corazon G. Buntag vs. Nida Paņa, et al.)

Pursuant to the ruling in Teresita G. Fabian v. Hon. Aniano A. Desierto, in his capacity as Ombudsman, et al., G.R. No. 129742, September 16, 1998, which invalidates Section 27 of Republic Act No. 6770 (Ombudsman Act of 1989) together with Section 7, Rule III of Administrative Order No. 07 (Rules of Procedure of the Office of the Ombudsman) and any other provision of law or issuance implementing the aforesaid Act insofar as they provide for appeals in administrative disciplinary cases from the Office of the Ombudsman to the Supreme Court, and enunciates that in line with the regulatory philosophy adopted in appeals from quasi-judicial agencies in the 1997 Revised Rules of Civil procedure, appeals from decisions of the Office of the Ombudsman in administrative disciplinary cases should be taken to the Court of Appeals under the provisions of Rule 43 of the same Rules, the Court RESOLVES to REFER this case and DIRECT the transmission of the records to the Court of Appeals for proper disposition.
