Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 10 2003.

G.R. No. 147589 (Ang Bagong Bayani-OFW Labor Party [under the Acronym OFW], represented by its Secretary General Mohamad Omar Fajardo vs. Commission on Elections) and G.R. No. 147613 (Bayan Muna vs. Commission on Elections.)

The Court Resolved to require petitioner Bayan Muna to file a REPLY within ten (10) days from notice on the separate Comments:

(a)  dated 16 April 2003 on the motion and supplemental motion of Bayan Muna to set aside COMELEC Resolution No. NDC-02-001 promulgated on November 6, 2002 filed by counsel for AKBAYAN,

(b)  dated 16 April 2003 on the aforesaid motion and supplemental motion of Bayan Mina filed by counsel for CIBAC,

(c)  filed by counsel for APEC, all in compliance with the resolution of 8 April 2003.

The Court further Resolved to DENY, for lack of merit, the Motion for Leave of Court to Admit NCIA’S resolution dated 28 April 2003 filed by counsel praying that NCIA’s Resolution No. 1 series of 2003, be admitted.

Acting on the Supplemental Position Paper dated 15 May 2003 filed by counsel for respondent Bigkis Pinoy Foundation, Inc. (BIGKIS) praying that the COMELEC’s partial compliance report dated 27 July 2001 be set aside and declare that BIGKIS PINOY possesses all the qualifications and none of the disqualifications of an organization participating in the party list system, the Court further Resolved to DENY the aforesaid prayer, there being no substantial arguments presented to warrant the reversal of the questioned resolution arguments presented to warrant the reversal of the questioned resolution.
