Before the Court is a Manifestation dated August 3, 2005 filed by respondent Judge Evelio F. Ilanga stating that he prefers to have this administrative matter tried on the merits.

IN VIEW THEREOF, Judge Gerardo D. Diaz, Executive Judge of the Regional Trial Court, Dumangas, Iloilo, Branch 68, is hereby ordered to conduct an investigation on this administrative matter and to submit his report and recommendation thereon within sixty (60) days from receipt of the records.
