G.R. No. 136506 (REPUBLIC OF THE PHILIPPINES vs. HON. ANIANO DESIERTO, ET AL.)

Acting on the Motion dated February 2, 2005, filed by the Heirs of Maria Clara Lobregat, to dismiss the instant case insofar as respondent Lobregat is concerned due to her death on January 2, 2004, and taking into consideration the Manifestation in lieu of Comment to said Motion filed by the Office of the Solicitor General expressing conformity thereto, the Court hereby GRANTS the motion to dismiss without prejudice to the continued prosecution of Civil Case No. 0033-C pending with the Sandiganbayan.
